Court relists suit filed against EFCC by former staff

JUSTICE Rakiya Haastrup of the National Industrial Court, Abuja, on Tuesday ordered the relisting of a suit filed against the Economic and Financial Crimes Commission (EFCC), by its former staff, Abraham Abutu.

The claimant instituted the action against the anti-graft agency in 2014, challenging his unlawful dismissal.

Haastrup struck out the suit on Jan.30, 2017 for lack of diligent prosecution.

But at the resumed hearing, the claimant told the court that he was not served the hearing notice.

He told the court that he changed counsel, adding that the Jan. 30, hearing notice was served on his former counsel.

Haastrup in her ruling said that “from the foregoing, I am convinced that the claimant was not served with hearing notice before his suit was struck out, which is in breach of his right to fair hearing.

“Therefore, this suit is hereby ordered relisted and transferred to the general cause list.’’

The case was adjourned till May 10, for hearing. (NAN)
