Man seeks custody of 3 children, as ex-wife remarry

A 45-year-old man, Hassan Muhammad, on Tuesday prayed the Sharia Court II sitting at Magajin Gari, Kaduna to grant him custody of his three children who were staying with his former wife, Bilkisu Abubakar.

The complainant, a resident of Rafin Guza Kaduna, told the court that the defendant had remarried and he does not want his children to be raised by another man.

In her defense, Bilkisu also residing at Rafin Guza, reminded the court that it granted her the custody of the children in 2018 due to the complainant’s inability to take care of them.

“When I visited the village, I saw my children in a sorry state; two of them were seriously sick and the other two were said to have gone to the bush to graze animals.

“Eventually, one of my sons died and I wasn’t informed until when I filed a suit against him”, she said.

She added that she was still living with her children and had not relocated to her new husband house.

Muhammad however insisted that he had also remarried and now has a wife to take care of the children.

The judge, Malam Murtala Nasir after listening to both parties, ruled that  the children should remain with their mother, but should be allowed to visit their father as appropriate.
