Alleged theft: Court issues bench warrant against 3 men

A Grade 1 Area Court, Kubwa, on Tuesday issued a bench warrant authorising the arrest of Khalipa Mohammed, Alhaji Ibrahim and Salifullahi Ali over failure to appear for trial.

The judge, Muhammad Adamu issued the warrant following an oral application made by the prosecution counsel, John Okpa who noted that the defendants were absent from defending the charge against them.

Adamu also ordered that the sureties should be served with notices to show cause, why the bail bond entered, should not be forfeited.

He adjourned the matter until Oct.5  for hearing.

The police charged the defendants with joint act, mischief and theft, which they pleaded not guilty to.

Earlier Okpa told the court that the complainant, Mr Ikechuckwu Odo reported the matter at Byazhin Police Station on Dec. 24.

He said the defendants jointly beat up the defendant while he was on his way from his shop along Byazhin market, Kubwa on the said date.

The prosecution counsel said the defendants broke the complainant’s windscreen valued N50, 000 and stole N275, 000 cash from him.

He added that the offence contravened  the provisions of sections 79, 327 and 288 of the Penal Code.
