Police arraign man over alleged assault, breach of peace

THE police in Osun on Tuesday, arraigned one Elusoji Olayiwola, 63, before an Ile-Ife Magistrates’ Court over an alleged assault and breach of public peace.

The Prosecutor, Sgt. Adesina Elijah, told the court that the defendant committed the offence on March 15, 2020 around 11:30 am at Erinta Village, off Ilesa Road, Ile-Ife.

Elijah said that the defendant conspired with others now at large in a manner likely to cause the breach of peace.

He added that the defendant threatened the workers of Francis Odeniyi while working on his land with cutlasses and canes which caused fear in the environment.

According to him, the defendant was in possession of dangerous weapons such as: cutlass, canes and iron.

The prosecutor stated further that the defendant assaulted one Alaba Adefisayo with cutlass, cane and iron which caused him injuries on his body.

He said that the offence contravened sections 249(d), 355 and 516(A) of the Criminal Code, Laws of Osun, 2002.

The defendant however pleaded not guilty to three-count charge of conspiracy, assault and breach of public peace.

The Defence Counsel, Mr Martins Awe, applied for the bail of the defendant in most Liberal terms, with a promise that his client would not jump bail, but would provide substantial sureties.

Magistrate A.A. Ayeni granted bail of the defendant in the sum of N100,000 with one surety in like sum.

Ayeni said that the surety must swear to an affidavit of means, resides within the court jurisdiction and his address to be verified by the prosecutor.

He added that the surety must also provide three years Tax Clearance Certificate as well as present three recent passport photographs each.

The case was however adjourned until Sept. 17 for hearing. (NAN)
