Appointment of permanent secretaries depends on president’s; governor’s discretion

THE Chairman of the Nigeria Barr Association (NBA), Enugu State Branch, Chief CNN Nwagbara, has said the appointment of permanent secretary depends on the description of the president and governors.

Nwagbara made the disclosure in Enugu on Thursday in an interviews with the News Agency of Nigeria (NAN)

The chairman said that in line with section 208, sub section 1, of the 1999 constitution, state governors are given the powers to appoint permanent secretaries, secretaries of state the governments, heads of service and other chief executives in charge of ministries, parastatal and agencies.

He explained that the provision did not specify conditions the person must meet before he or she would be appointed as perm secretary.

“I know that there are provisions in the civil service rule, practice and procedure over the time which, to the best of my knowledge, says that a person must attain level 15 before he or she will be appointed as perm secretary.

“Though by practice and powers bestowed on the governors in section 208, says state governors have the power to appoint any person in senior cadre even if the person has not attained level 15.

“It is expected that the governors should observe seniority because a permanent secretary is expected to be the most Senior person in civil service rule.

“The governor should not abuse it by bringing any junior person from anywhere to head his or her seniors unless where the most senior is not physically fit to handle such a position.

“If a governor, because of the powers given to him, decides to abuse it, it will not be good for democracy and a time will come where level five officers, because he or she is related to the governor, will be appointed a permanent secretary without requisite knowledge and experience,” he noted (NAN)
