THE magistrate court sitting in Yaba Lagos yesterday adjourned the case involving Ojukwu Chidinma and Adedepo Quadri in the murder of Osifo Ataga to September 29, 2021.
The Magistrate, Olarunbosun, who presided over the case on Monday, September 06, 2021, said that based on the advice of the DPP, which she received on August 20, the defendants, Chidinma and Quadri would be tried in the High Court as they both have a case to answer in the gruesome murder of Usifo Ataga.
In addition, the court discharged four suspects linked to Ataga’s murder case and also ordered that another suspect Ojukwu Onoh be made to face trial for being in possession of Ataga’s property, which were with the late Ataga before his death.
The other defendants, Babalola Disu, Abayomi Olutayo, and Ifeoluwa Olowu, were, however, discharged and their names cleared from the case on the grounds that the evidence produced by the prosecution was not sufficient to link them with the offence alleged against them.
According to the court proceedings, the counsel for the Defendants informed the Court that the police were strategically placed in the court premises to re-arrest the Defendants based on the advice of the IGP. They urged the court to restrain the Police from further re-arresting them.
But the Prosecutor urged the court to jettison the application of the counsel for the Defendants, and submitted that if the Defendants’ rights are violated, they should have recourse to the law.
The Magistrate ruled that counsel for the Defendants were being speculative and that Courts do not act on speculations. The Magistrate ordered that counsel and parties should not grant any press interview or press conference regarding the matter. The matter was adjourned to 29th September, 2021.
