An FCT High Court, Apo, on Tuesday discharged and acquitted a 26-year-old cab driver, Salish Umoru, charged with conspiracy and armed robbery.
Justice Idris Kutigi, in his judgment, said that the prosecutor failed far short of proving the offence against the defendant beyond reasonable doubt.
“Having failed to do so, the defendant is accordingly found not guilty of the offence as charged and he is hereby discharged and acquitted.
“The prosecutor has failed to prove the essential elements of the offence for which the defendant is charged and the case must necessarily fail,’’ he said.
The prosecutor, Mr Yusuf Lawan had informed the court that the defendant committed the offence on Aug. 17, 2015 at Kpeyegyi, Abuja.
He said that the defendant with others at large, robbed one John Onuzulike of Plot 85, Kpeyegyi Layout.
He further said the defendant at gun point robbed Onuzulike of Toyota Highlander jeep valued at N2, 225, 000, two IPad phones and N16, 000 cash.
The prosecutor said that the offences contravened Sections 97 and 298 of the Penal Code. (NAN)
