Court dissolves 4-year-old marriage over irreconcilable differences

AN Upper Area Court in Kubwa, Abuja on Tuesday dissolved a four-year-old marriage between a businessman, Musa Habeeb and his wife, Mulikat Shuaibu over irreconcilable differences.
The Judge, Muhammad Wakili, dissolved the marriage according to Islamic laws, following Habeeb’s prayer to the court for confirmation of divorce to his wife.
Wakili ordered Shuaibu who was pregnant to stay in Habeeb’s house until delivery and after delivery, urging him to get a befitting apartment for her and his children(one daughter and the unborn baby).
He said the apartment would be checked by the court officials before she move in.
Earlier, Habeeb told the court that he pronounced divorce to Shuaibu in 2023 but she refused to leave his house.
“I consulted with my lawyer, Abdulwaheed Yakubu to get a divorce letter from the court on Dec.18, 2023, which has been done.
“Shuaibu is no longer my wife, I want the court to order her to leave my house,” Habeeb said.
Shuaibu’s counsel, Sherifdeen Bello, however, said that the divorce wasn’t valid adding that it was based on procedures in Islam.
” The procedures have not been followed, if the plaintiff claims to have divorced his wife, she has not observed “Iddah” which is a waiting period of three months according to Islamic injunction, before contracting another marriage, ” Bello said.
He said that Habeeb had not paid any money to Shuaibu who was heavily pregnant, for maintenance since Dec. 10, 2023, but paid on Jan. 8 because the matter had been taken to court.
In response, the plaintiff ‘s counsel said that Habeeb was up and doing with his obligations in his home and urged the court to discountenance the application of the respondent.(NAN)
