Court grants stay of execution sacking Alex Otti, clears ground for swearing in on Monday

MANY people from Abia State who have been worried over the fate of Alex Otti, governor-elect, can now heave a sigh of relief. The appellate court in Kano has granted a stay of execution suspending the judgement of a lower court sacking the governor.

Realnews reports that the Court of Appeal in Kano, presided over by Justice Mbaba today, Saturday, May 27,  granted the application of Alex Otti, governor-elect, Abia State, to appeal as an interested party and suspended the judgment of the Federal High Court pending the appeal.

Realnews recalls that the recent judgement made by Justice M.N. Yunusa of the Federal High Court in Kano, nullified the election of  Otti  and other Labour Party candidates because of alleged late submission of names to the Independent National Electoral Commission, INEC.

Consequently, the Kano High Court in it’s judgement declared all votes cast for Labour Party (LP) candidates in Kano, Abia, and other states as wasted votes.

However, with the decision of the apellate court on the stay if execution after Otti’s legal team made the request to put  the lower court’s judgment on hold, the coast is clear for the swearing of the governor-elect on Monday. 

Realnews reports the ruling today followed appeal filed by Umeh Kalu, a Senior Advocate of Nigeria (SAN) representing the Labour Party, urging the higher court to overturn the trial court’s judgment.

Kalu argued that the trial court had made a legal error and caused a miscarriage of justice by entertaining a lawsuit that lacked any legal basis. – with report from the Peoplesvoice.ng
