Court issues bench warrant against couple for alleged defamation

A Grade 1 Area Court, Kubwa, has issued a bench warrant authorising the arrest of a businessman, Mr James Chukwu and his wife, Chiwendu for alleged defamation of character.
The complainant, Mrs Ruth Enabosi had filed a direct criminal complaint against the couple through her counsel, Anenih Enabosi.
The Judge, Muhammad Adamu, issued the warrant and ordered that the case be transferred to the Kubwa Police Division for investigation, following an oral application made by Enabosi.
Earlier, Enabosi told the court that while the bailif of the court, Dangana Bawa went to effect service to the suspects, there was a conflict between them and the bailif.
He said Chukwu threatened the bailiff, saying he was lucky that he was in the rest room when he came to effect service.
Enabosi, however, applied for a bench warrant against the couple and for an order for the matter to be transferred to the police for proper investigation.
The complainant’s counsel had alleged that the couple, whom are the complainant’s neighbours, formed the habit of engaging in illegal connection of electricity in their compound at Byazhin, Abuja.
He said that the couple were cautioned by the Abuja Electricity Distribution Company (AEDC), Byazhin, Abuja following their unlawful act.
“The couple confronted the complainant and accused her of reporting them to the AEDC for their illegal connections.
“Chiwendu recently went ahead to remove the complainant’s washed clothes from where she dried them in the compound and called her a prostitute in public,’’ he said.
Enabosi said that the suspects threatened to eliminate the complainant and her family if she continued to live in the same compound with them.
The offence, he said contravened the provisions of Section 391 of the Penal Code. (NAN)
