An Osun State Magistrates’ Court in Ile Ife, presided over by Muhibah Olatunji has rejected the oral bail application of a clergy, Rev. Isaac Agboola, who allegedly defrauded a community leader of the sum of N14m.

The accused was said to have fraudulently obtained the sum from a community leader, Otunba Adeniyi Adeoye, with the promise to sell a parcel of land to him.

Agboola’s counsel, Mr Ben Adirieje, had requested his bail orally, but the magistrate demanded a formal bail application.

Addressing the court, the Prosecutor, Inspector Sunday Osanyintuyi, explained that Agboola and others still at large, committed the offence in 2010 at Modomo Community, opposite Obafemi Awolowo University, Ile-Ife.

According to him, Agboola and others yet to be apprehended, obtained the said sum under false pretence.

He added that the accused and others stole and converted to personal use, N14m belonging to one Otunba Adeniyi Adeoye.

Osanyintuyi maintained that the accused and others, with their actions, conducted themselves in a manner that could cause a breach of peace, having fraudulently collected money with a promise to sell a parcel of land to the complainant.

He stated further that the offence committed by the accused and others, contravened Sections 249 (D), 383, 390 (9) and 516 of the Criminal Code, Laws of Osun, 2002.

Commenting on the bail application, Magistrate Muhibah Olatunji, told counsel for the accused person to file a formal application for his bail.

She ordered that the accused be remanded in Ile-Ife prison custody and adjourned sitting in the matter till December 17, 2018, for a mention. – Punch
