A Makurdi Magistrates’ Court on Monday ordered that a farmer, Job Ogigbo, be remanded in a correctional centre in Makurdi for alleged culpable homicide.
The police charged Ogigbo, who lives in Obi Local Government Area of Benue with conspiracy and culpable homicide.
Magistrate Erdoo Ter did not take the plea of Ogigbo for want of jurisdiction.
She ordered the police to return the case file to the Director of Public Prosecutions for legal advice.
Ter adjourned the case untill July 20.
Earlier, the prosecution counsel, Insp James Ewache told the court that a petition was written by a lawyer, Onche Adokele, on behalf of Joel Ogbile to the State CID Makurdi on April 23.
He said that Ogigbo and Godwin Mark, at large, attacked and killed Jeremiah Agwu , on his way to Otukpo on his motorcycle.
During police investigation, he said Ogigbo was arrested in connection to the offence while Mark is still at large.
The prosecution further told the court that investigation into the matter was still in progress and prayed the court for an adjournment.
The offence, he said, contravenes the provisions of section 97, 398 and 222 of the Penal Code law of Benue 2004. (NAN)
