A Chief Magistrates’ Court in Kaduna, on Friday ordered that 38-year-old labourer, Yusuf Saleh, charged with culpable homicide, be remanded in a correctional centre pending legal advice.

The Chief Magistrate, Lukman Sidi, declined to take the plea of the accused, on the grounds of lack of jurisdiction.

Sidi said that the offence could only be tried by a High Court.

He ordered the police to forward the case file to the State Director of Public Prosecutions, for legal advice.

The magistrate adjourned the matter until Nov. 29, for mention.

Earlier, the Prosecutor, Insp. Chidi Leo, told the court that the complainant, Adamu Musa, reported the matter at the Kachia Police Station on Nov. 3.

Leo alleged that Saleh and the deceased had an altercation and he hit him on the head with a stone.

The prosecutor said that during investigation, the accused confessed to the crime.

He said the offence contravened Section 190 of the Kaduna State Penal Code, 2017. (NAN)
