A Minna High Court 4, has granted leave to Mr Mohammed Ndayako (SAN) of Bastion Chambers, to serve a writ to the Nation Newspaper for libelous publication against the Chairman of the Niger state Board of Internal Revenue Service, Mr Mohammed Etsu.
Justice Mohammed Mohammed, of Minna High Court 4, granted leave to counsel to the revenue board chairman during a court proceeding in Minna on Monday.
The News Agency of Nigeria (NAN) reports that the court granted the leave after counsel to the plaintiff had filed motion before the court demanding N150 million damages against the national daily’s publication of Nov. 5.
Ndayako told the court that the national daily had on its publication written a story on a petition against his plaintiff to the state governor on an allegedly forged letter head of a law firm, Nuhu Edah & Co. Success Chambers,
He said the petition was written by Danjuma Ibeto and Garba Abdullah who allegedly forged the letter head of the said law firm that had denied writing such petition.
Ndayako said based on the application made to the court by the counsel to the plaintiff, the court granted leave to the counsel to serve the national daily formally in Lagos.
He said the writ contained N150 million damages on the plaintiff, request for an apology and for retraction of the story published by the Nation Newspaper and two other national dailies. (NAN)
