Court to Rule on Kanu’s Case December 16

A MAGISTRATE court sitting Abuja has fixed December 16, for ruling on the charges instituted against Nnamdi Kanu, director, Radio Biafra, by the Department of State Services, DSS. The court is to decide whether or not to strike charges against Kanu brought before. The ruling was earlier scheduled for December 1, but Shuaibu Usman, presiding magistrate, could not sit because he lost his father.
Usman had on November 22, 2015 adjourned to earlier date for his ruling on an application by Moses Idakwo, counsel to the DSS, to discontinue the case against Kanu on the grounds that he would be charged with acts of terrorism. Idakwo cited section 108(1) of the Administration of Criminal Justice Act 2015, saying there were fresh facts in the case which could not be entertained under the court’s jurisdiction.
But Jude Aboje, leading counsel to Kanu, opposed the application for discontinuance of the case, demanding that the orders of the court directing the release of the accused from the DSS custody must be complied with before the case could be struck out.
Although the court did not sit on December 1, there were some disturbances in front of the court premises as Kanu’s supporters went on a protest match. They also held placards bearing inscriptions of solidarity for Kanu.
