FIRS dragged to National Industrial Court for alleged wrongful retirements

TWO former directors of the Federal Inland Revenue Services, FIRS, Emmanuel Obeta and Victor Ekundayo have sued the FIRS for alleged wrongful retirement from the services of the organization.
In the originating summons, which was filed and served on all the parties by Amauche Onyedum from the Ozekhome Chambers and supported with a 32-point affidavit, the two Claimants requested among others that their retirement by the FIRS was “unlawful, illegal, wrongful, null and void and of no effect whatsoever”.
The suit, which has the Office of the Head of Service and the Attorney General of the federation and minister of justice as defendants requested the Court to determine that the purported compulsory retirement of the Claimant by the FIRS, the 1st Defendant was unlawful, illegal and wrongful in the circumstances of this case.
In the case presided over by Justice Benedict Kanyip of the National Industrial Court, the FIRS lawyers raised a motion of preliminary objection to the court, pointing out that they were only served on getting to the court that morning and were therefore seeking to regularize their appearance on the matter.
But Onyedum, lawyer to the Claimants did not object, but pointed out that she had filed her reports on the points of law, which had been served on the relevant parties.
In his ruling, Justice Kanyip took notice of all the issues raised and admitted all the documents filed and adjourned the matter for hearing on October 6, 2021 with an order that the hearing notice should be issued and served on all the parties.
