Learned Silk Case: Court restrains FCT Minister from taking custody of Garki Hospital

THE High Court sitting in Federal Capital Territory, FCT, Abuja has restrained the Minister of Federal Capital Territory, FCT and FCT Administration, their agents, privies representatives, servants or anyone whosoever acting on their behalf or instruction(s) from taking custody of Garki Hospital Abuja.

In a SUIT NO: FCT/HC/CV/954/2022, delivered by Justice O.C. Agbaza on Thursday, March 24 said upon the hearing of the Motion Exparte with Motion NO M/3602/2022 dated 24 March, 2022 and filed on the 22/3/2022 brought pursuant to Order 43 Rules 1 (1) (2); (3) of the Federal Capital Territory, Abuja (Civil Procedure) Rules 2018 and under the inherent jurisdiction of this Hon. Court.

Upon an Order of Interim Injunction:

“Restraining the Minister of FCT and FCT Administration as Defendants/Respondents, their agents, privies representatives, servants or anyone whosoever acting on their behalf or instruction(s), from taking custody of Garki Hospital Abuja and or from implementing, effecting or actualizing or giving any effect, implementation or actualization howsoever to their 1 March 2022 letter or taking any action or step(s) whatsoever as contained or expressed in their 1 March, 2022 letter to the Claimant/Applicant on the Concession Agreement and the taking custody of Garki Hospital Abuja, pending the determination of the Motion on Notice.

“The Defendants/Respondents, their agents, privies representatives, servants or anyone whosoever acting on their behalf of instruction from interfering with, disturbing, hindering or obstructing in any way or in any manner of by any means or method or device whatsoever or howsoever the activities, business, management, practice and or services of the Claimant/ Applicant at the Garki Hospital Abuja, pending the determination of the Motion on Notice.

“And for such further Order(s) that the Honourable Court may deem fit to make in the circumstances of this case,” Justice Agbaza said.

Upon the reading of the Joint affidavit of 35 (Thirty Five) paragraphs deposed to by one Dr Adamu Onu.

Justice Agbaza said upon further hearing of Bola Olotu (SAN) with John Ikenwe Esq, counsel for the Claimant, this order shall be served on the Respondents, along with the Motion on Notice already filed.

The Return date is fixed for 30/3/2022 for hearing of the Motion on Notice.
