A Kaduna Chief Magistrates’ Court on Thursday sentenced a 38-year-old man, Yusuf Adeyemi to 18 months imprisonment for N3.3 million property fraud.
The police charged Adeyemi on a two counts of obtaining money under false pretences and theft.
Delivering judgment, Magistrate Ibrahim Emmanuel, held that the prosecution proved its case beyond reasonable doubt, which is the legal burden of proof required to affirm a conviction in a criminal case.
Emmanuel, however, gave the convict an option of N40, 000 fine.
He also ordered the convict to pay restitution of N3.3 million to the complainant, Edward David.
Earlier, the Prosecution Counsel, Insp. Chidi Leo, had told the court that the convict committed the offence in January 2022 at Barnawa area in Kaduna.
Leo said that the convict collected N3.3 million from the sale of a property that belonged to the complaint, but converted the money to his personal use.
The offence, he said, contravened the provision of Sections 390 and 341 of the Penal Code of Kaduna State, 2017. (NAN)
