Reprieve for Asue Ighodalo as appeal court affirms him as PDP candidate

THE cloud hovering over the political ambition of Asue Ighodalo, governorship candidate of the Peoples Democratic Party, PDP, in Edo State has been cleared. On Monday, August 26, the Appeal Court in Abuja, upheld the primary election that produced Ighodalo as the governorship candidate of the PDP in Edo State.
Judges at the Appeal Court unanimously
ruled that the delegates who sought to nullify the PDP primaries that produced Ighodalo as the candidate lacked locus standi, and therefore the trial court has no jurisdiction to nullify the PDP primaries.
The judgement was delivered by Justice JCA Musali in the suit marked CA/ABJ/CV/764/2024.
According to the court, under s. 84 (14) of the Electoral Act, it is only aspirants that can challenge a primary election. Ad hoc delegates are not aspirants and therefore do not have the locus standi drag the matter which is the internal affairs of PDP to court.
Musali said: “They are delegates and not aspirants. Delegates do not have any locus standi to challenge the process of the primary election.”
Realnews reports that the February 22, primaries of the PDP in Edo State has been contested by some delegates after their aspirants were defeated in the race to the Edo State government house scheduled to hold on September 21.
